Two engineering firms recently appeared in court following the death of a contractor through working at height.

Under the Health and Safety at Work Act 1974, Advance Door Engineering Ltd and Shufflebottom Ltd appeared in Swansea Crown Court facing charges relating to a contractor’s death at Pembroke Dock’s Mustang Marine in June 2013.

Mr Greenway (the contractor) suffered multiple injuries after falling 60 feet from a cherry picker crane.  He was employed by Shufflebottom Limited as a contractor through Advance Door Engineering.

The charges:

Shufflebottom:

  • Failing to select the most suitable equipment for use at height
  • Failing to take reasonable steps to identify health and safety risks
  • Failing to make a suitable assessment of Health and Safety risks to workers

Advance Door Engineering:

  • Failing to select the most suitable equipment for use at height
  • Failing to make suitable assessment of health and safety risks to persons not employed by them
  • Failing to plan, manage and monitor construction of the roller shutter doors
  • Failing to make a health and safety risk assessment

The trial is still on-going and both companies are awaiting the decision of the Court on how best to deal with their charges.
